Red Lodge City Court returns home after interlocal agreement collapses

Red Lodge Mayor Bill Larson has taken immediate action to transfer City Court from the Carbon County Court House back to City Hall after the breakdown of an interlocal agreement between the two entities.

Carbon County Attorney Alex Nixon informed Red Lodge City Attorney Rebecca Narmore that the County Commissioners voted to rescind the recent contract submitted to the City and was no longer interested in a joint court.

The issue between the County and City over the contract came down to a dispute over one paragraph. That contained an indemnity agreement, or hold harmless agreement. Since City Court is held at the Carbon County Courthouse, the County Commission wanted the new contract to include an indemnity agreement stating that the City of Red Lodge would defend and indemnify the County and its employees for any and all allegations, claims, actions, suits, demands, damages, liabilities obligations, losses settlements, judgments, cost and expense which arise out of any act or omission of the County, its employees or agents.

The City of Red Lodge objected to this language on the advice of the city attorney and the City’s insurance carrier who raised the issues of assuming another party’s negligence and coverage issues under the city insurance policy.

The contract currently in place and signed in 2014 did not include an indemnity agreement.

The Interlocal Agreement provided services to the City Court through the County Court with the Justice of the Peace, Kevin Nichols, being employed as the City Judge as well.
